Duke Energy filed a complaint at FERC seeking $9.8 million in unrecovered costs which is said resulted from following PJM directives for certain of its merchant units to be available, but which were not dispatched.
The Lee Energy Facility gas-fired units at issue, located in Northern Illinois, have a capacity obligation.
Duke said that due to PJM directives, it purchased approximately $12.46 million worth of gas that it would not otherwise have bought, which, after mitigation efforts, leaves Duke with about $9.8 million in unrecovered costs.
