Luminant, Texas Staff File Voluntary Mitigation Plan

Luminant Energy Company LLC and Staff of the Public Utility Commission of Texas have filed for approval of a voluntary mitigation plan (VMP).

The VMP provides Luminant an absolute defense against an allegation pursuant to PURA § 39.157(a) and P.U.C. SUBST. R. 25.503(g)(7) of an abuse of market power through economic withholding, with respect to the specific behaviors addressed by the VMP, as provided in PURA § 15.023(f) and P.U.C. SUBST. R. 25.504(e).

The VMP addresses Luminant's offer strategy for five different generation technology types (nuclear, coal (including lignite), non-quick start operated natural gas, quick start natural gas, and intermittent renewable resources), as well as load resources in Security Constrained Economic Dispatch.
