Dominion Virginia Ordered To Immediately Process Enrollments From Retail Electric Suppliers For 100% Green Customers

The Virginia SCC issued an order directing Dominion Virginia Power, "to immediately resume processing enrollment requests under Section A 5 for customers who wish to purchase from Direct Energy or Calpine," pending a final order from the Commission concerning a dispute regarding the requirements for customers to take 100% renewable electric supply from retail suppliers

As previously reported by EnergyChoiceMatters.com, Direct Energy and Calpine sought to serve customers under the statutory provision which allows customers to take service from a competitive retail supplier for 100% renewable energy supply, in the absence of a utility tariff for 100% renewable energy supply (Section A 5)

Dominion argued that the suppliers must make a showing that they have control of sufficient renewable "capacity" to qualify for the statutory exemption allowing retail choice for 100% renewable energy, and refused to process enrollments barring such showing. Dominion Virginia has sought a declaratory order from the SCC to such effect

Direct Energy and Calpine argued that no such standard exists under the law or SCC regulations, and, in motions for injunctive relief, the suppliers said that Dominion lacked the authority to not process the enrollments

The SCC ordered Dominion to immediately resume processing Section A 5 enrollments of Direct Energy or Calpine pending final disposition of the matter
