Attorney General Seeks "Full Investigation" Of Purchase Of Receivables Filing, Full Evidentiary Proceeding

The Massachusetts Office of the Attorney General (AGO) has requested that the Massachusetts DPU "fully investigate" the annual update by Nstar (Eversource) to Nstar's standard complete billing percentages (SCBPs), or purchase of receivables (POR) discount rates, with Nstar's updates proposed to be effective May 1, 2026
The AGO said that the DPU's formal investigation, "should provide the opportunity for a full procedural schedule with dates for discovery, expert testimony, evidentiary hearings, and submission of briefs, and should comply with all other requirements set forth in G.L. c. 30A § 11.1".
The AGO's request is not typical in annual POR discount rate update proceedings. For example, the AGO did not make such a request in Nstar's 2025 POR discount rate update. To the extent the AGO's latest filing only represents a preservation of rights, and that the AGO may not necessarily seek hearing as the case progresses, it is still notable that similar filings were not made by the AGO in other prior annual POR update proceedings
Outside of the initial implementation of POR, and certain periods during the COVID pandemic, the annual POR discount rate updates have generally been considered by the DPU without witness testimony and evidentiary hearings (and even in cases where consideration was not a simple review, such additional process relied on written stakeholder comments rather than witnesses, and no hearings were conducted)
The AGO did not indicate what concerns the AGO may have which are prompting the AGO's request for a full investigation with hearings
Moreover, as of publication time, no comments or pleadings from any other stakeholder has been posted by the DPU which could have prompted concern from the AGO (such as in 2024 when NRG had sought modification of the as-calculated POR discounts to address lingering effects from a COVID-related disconnection moratorium); however, the public posting of filings may lag their official filing with the DPU
Additionally, as of publication time, there has been no public posting of any AGO request for a full investigation and hearing concerning National Grid's annual POR discount rate update; however, the public posting of filings may lag their official filing with the DPU
