Buckeye Energy Brokers Opposes Settlement In Disputed Municipal Aggregation Certification Case

Buckeye Energy Brokers filed comments at the PUC of Ohio in opposition to a recent settlement agreement among Eastern Power and Gas, LLC, Palmer Energy Company, Inc., and Newton Township, Ohio concerning Newton Township's certification by the PUC of Ohio as a governmental aggregator

In brief, and as previously reported, Palmer has alleged that Newton failed to complete the steps necessary for certification as an opt-out aggregator, though Newton received opt-out aggregator certification under PUCO's automatic approval process, with PUCO later granting rehearing of such automatic approval
Under the settlement, which remains subject to disposition by PUCO, Newton would be permitted to continue to operate the opt-out aggregation through December 5, 2026, without having to re-apply for certification for such period of service, with the settlement further providing that, "Palmer shall be the exclusive aggregator/broker under the supply contract for the Newton aggregation program -as [sic] defined in a separate agreement between Eastern and Palmer, and brokerage fees under the Newton aggregation program shall not be paid to any other brokers."
Buckeye, which has served as a consultant for Newton Township, alleged that the settlement, "would interfere with the Buckeye Energy Brokers agreement with Newton Township."
Buckeye said, "The term of the agreement is March 2026 to March 2029."
Buckeye argued that, "The PUCO certification process does not have a provision for Stipulations. This would set a
bad precedent. Anyone could file to intervene in an electric or natural gas certificate case to
'shake down' an applicant."
Buckeye alleged, "In this case, Palmer Energy
pressured Eastern Power & Gas and Newton Township to gain a broker fee from the Newton
Township program and to become the 'exclusive aggregator/broker' in exchange for the
program to exist".
Citing statute, Buckeye argued that, "It appears a Stipulation
cannot change a PUCO certificate."
Buckeye also alleged that the proceeding's schedule, "was rushed, unrealistic and resulted in no hearing
and possible contract interference between Buckeye Energy Brokers and Newton Township."
