PUCT Audit Finds Texpo Power Appropriately Implementing Lite-Up Discount

A PUCT Staff compliance audit concluded that Texpo Power has taken the appropriate steps to improve the application and reporting of the rate reduction discount under the Lite-Up Texas low-income discount program, and makes no recommendations for Texpo Power to implement within its operations (Docket 39506).


PURA Denies Motion to Re-open Docket on Supplier-Agent Relationship

The Connecticut PURA denied the Retail Energy Supply Association's motion to re-open the record in Docket 10-06-24, regarding the definition of "agent" and supplier responsibility for agents (10/11). PURA did extend the exceptions deadline to November 1.


OCC Seeks Rehearing of Transition to SCO Auction at Columbia Gas

The Ohio Consumers' Counsel and Ohio Partners for Affordable Energy have sought rehearing of the Public Utilities Commission of Ohio's recent order allowing Columbia Gas to proceed with a transition to a Standard Choice Offer auction, in lieu of the current Standard Service Offer auction, in 2012 (see 9/8). Among other things, OCC argued that the SCO is in violation of R.C. 4905.72 which OCC said, "prohibits any public utility from requesting or submitting, or causing to be requested, or submitted, a change in the provider of natural gas to a consumer in this state, without first obtaining, or causing to be obtained, the 'verified consent of the consumer' in accordance with rules adopted by the Commission."


Mass. DPU Approves Cost Recovery Mechanism for WMECO Renewable PPA

The Massachusetts DPU approved a 37.5 MW PPA between Western Massachusetts Electric Company and Noble Wind, LLC, with costs to be recovered from all distribution customers. WMECO will sell the energy and RECs from the PPA into the market, crediting any revenue against costs to be paid by distribution customers (11-12). Additionally, Noble shall bid the capacity into the ISO-NE FCA, with revenues or costs to WMECO (flowed through to distribution customers) from capacity determined based on a contract for difference versus the cost of capacity included in the PPA.
