Constellation to Pay $20,000 to Settle RRS Shortfall

Constellation Alliance II, LP (QSE) would pay $20,000 under a settlement with PUCT Staff to resolve Staff's allegations that Constellation violated PURA §39.151 (d) and (j) and P.U.C. SUBST. R. 25.503(f)(2), concerning failure to adhere to Electric Reliability Council of Texas (ERCOT) Protocol § 8.1.1.4.2(1)(b), relating to Responsive Reserve Service Energy Deployment Criteria during the February 2, 2011 Energy Emergency Alert (EEA) Event.
On February 2, 2011 ERCOT issued a Verbal Dispatch Instruction (VDI) to all QSEs with Load Resources (LR) to deploy their LR assets providing Responsive Reserve Service (RRS) as required in Level 2A of an Energy Emergency Alert (EEA) event. The official start time of the deployment was 05:24:20.
Staff alleged that Constellation only deployed 109.74 MW of its 131 MW RRS responsibility within the ten minute requirement (approximately 84% of its RRS obligation).
Staff also said that Constellation maintained a sustained combined Alternate and Default performance percentage factor of 100.4% for the February 2-3, EEA Level 2B event.
