Constellation to Pay $15,000 to Settle Xtend Energy Telemetry Failure

Constellation Energy Commodities Group would pay $15,000 under a settlement with PUCT Staff to resolve Staff's allegations that Constellation violated PURA § 39.151 (d) and (j) and P.U.C. SUBST. R. 25.503(f)(2), concerning failure to adhere to Electric Reliability Council of Texas (ERCOT) Protocol § 6.5.1.1, relating to the failure of Xtend Energy LP to provide the required telemetry related to its deployment of loads acting as resource (LaaR) on August 20, 2010.

Constellation acquired Xtend after the date of the violation.

Staff alleged that Xtend failed to provide accurate telemetry associated with its load acting as resource (LaaR) deployment during a North American Electricity Reliability Corporation (NERC)/Disturbance Control Standard (DCS) event on August 20, 2010.

Specifically, Staff said that Xtend's real time telemetry data indicated that it had not deployed enough of its LaaRs to reach 95% of its obligation within the 10-minute time requirement. However, Interval Data Recorder (IDR) data showed the appropriate amount of load was actually provided.

Staff reported that further investigation revealed issues with Xtend's telemetry equipment in the field resulting in questionable or unavailable data associated with some loads.
