10K Energy to Pay $20,000 to Settle PUCT Staff Compliance Audit

10K Energy, L.L.C. would pay $20,000 under a settlement with PUCT Staff to resolve allegations that 10K Energy was not in full compliance with 20 provisions of the Substantive Rules (40267).

The allegations resulted from a Staff compliance audit.

Specifically, Staff alleged that 10K Energy was not in full compliance with the following:

- P.U.C. SUBST. R. 25.474(h)(1), relating to telephonic enrollment. Staff alleged that 10K Energy failed to provide a recording of telephonic enrollment

- P.U.C. SUBST. R. 25.474(d)(5)(F), relating to required authorization disclosures in connection with enrollment via the internet. Staff alleged that 10K Energy did not disclose on its enrollment webscreen the presence or absence of early termination fees or penalties.

- P.U.C. SUBST. R. 25.474(d)(5)(I), relating to required authorization disclosures in connection with enrollment via the internet. Staff alleged that 10K Energy did not include on its enrollment webscreen a disclosure of the customer's right of rescission in the case of a switch request

- P.U.C. SUBST. R. 25.475(c)(2)(G), relating to general contracting requirements. Staff alleged that 10K Energy's website did not contain the current price for the variable price product or the history for the life of the product.

Prior to settlement, 10K Energy corrected all of the alleged deficiencies
