Pegasus Alliance Corporation to Pay $15,000 to Settle PUCT Staff Compliance Audit

Pegasus Alliance Corporation would pay $15,000 under a settlement with PUCT Staff to resolve allegations that Pegasus Alliance Corporation was not in full compliance with 30 provisions of the Substantive Rules (40476).

The allegations resulted from a Staff compliance audit.

Specifically, Staff alleged that Pegasus Alliance Corporation was not in full compliance with the following:

• P.U.C. SUBST. R. 25.474(e)(5)(I), relating to authorization disclosures for written enrollment. Staff alleged that Pegasus Alliance Corporation did not include the right of rescission on the LOA.

• P.U.C. SUBST. R. 25.474(h)(4)(G), required authorization disclosures for telephonic enrollment. Staff alleged that Pegasus Alliance Corporation did not include a fee that was referenced in the Terms of Service (TOS).

• P.U.C. SUBST. R. 25.474(h)(5)(B)(vi), relating to verification of authorization of telephonic enrollment. Staff alleged that Pegasus Alliance Corporation did not obtain one of the access verification options required by the rule.

• P.U.C. SUBST. R. 25.475(d)(2)(C), relating to price changes. Staff alleged that Pegasus Alliance Corporation did not include a statement on its variable rate billing on how to obtain information about the price that will apply on the following bill.

Prior to settlement, Pegasus Alliance Corporation corrected all of the alleged deficiencies
