Texas Retail Provider Files to Use Trade Name BrightStar Power

Clearview Electric. Inc. has filed for an amended Texas retail electric provider certificate to use the trade name BrightStar Power, and to reflect information showing compliance with the financial security required under PUC SUBST R. 25.107(f).

Specifically, Clearview Electric, Inc. said that it has entered into an Energy Market Support Agreement with Luminant Energy Company LLC whereby Luminant has agreed to act as Clearview's guarantor in order to satisfy the financial requirements set forth in PUC SUBST. R. 25.107(f)(1)(A)(ii).

Clearview is currently operating in ERCOT under a "temporarily suspended" REP certificate, meaning that Clearview cannot enroll new customers but may continue to serve existing customers.

As previously reported, the suspension allowed Clearview to remain in the market by posting a $30,000 letter of credit, as opposed to the requirements of SUBST R. 25.107(f)(1), through December 31, 2012. The suspension order provided that Clearview's REP certificate shall be revoked if it fails to comply with SUBST R. 25.107(f)(1) on or before December 31, 2012.

Though Clearview filed the REP certificate amendment showing compliance with SUBST. R. 25.107(f)(1), it did not specifically petition to lift the prior suspension of the REP certificate (it is not clear if such separate relief would be required, or if granting the sought certificate amendment would necessarily provide such relief)
