Michigan Initiates Proceeding to Revoke License of Retail Supplier

The Michigan PSC has commenced formal proceedings to revoke the alternative electric supplier license of Nordic Marketing, LLC.
According to PSC reports, Nordic Marketing, LLC, which is based in Ann Arbor, Michigan, has not served electric customers at Detroit Edison or Consumers Energy since 2005.
Nordic Marketing, LLC was granted an AES license on August 17, 2000.
Section 23 of Public Act 295 of 2008, MCL 460.1023, requires all AESs and member-regulated cooperative electric utilities to file a proposed renewable energy plan (REP), which is subject to approval by the Commission. MCL 460.1023(4) provides that every two years after initial approval of the REP, the Commission shall review the REP after providing an opportunity for public comment. On May 26, 2009 in Case No. U-15838, Nordic Marketing, LLC was directed to comply with the requirements of Public Acts 286 and 295 of 2008
"The Commission Staff (Staff) noted that Nordic [Nordic Marketing, LLC] has not met the statutory and regulatory responsibilities of a licensed AES," the PSC said.
The PSC said that on July 26, 2012, Bill Stosik, Director of the Commission's Financial Analysis & Audit Division, sent a letter to Nordic Marketing, LLC inquiring "whether your company wishes to retain its license" to provide electric service to retail customers in Michigan. The letter also notified Nordic Marketing, LLC of past unsuccessful attempts by the Staff to contact the company by mail, telephone, and e-mail. The letter requested that Nordic Marketing, LLC "respond in writing to this inquiry no later than 45 days from the date of this letter and indicate if the company intends to retain its license or has ceased operations." Finally, the letter notified Nordic Marketing, LLC that "if no response is received, the Commission will take the necessary steps to commence the process of revoking its license." To date, there has been no response to Mr. Stosik's letter, the PSC said.
"The Commission finds that the preliminary steps for license revocation required in MCL 24.292 and Rogers, supra, have been completed and that the Commission may now commence formal proceedings to revoke Nordic's [Nordic Marketing, LLC] AES license. If Nordic [Nordic Marketing, LLC] desires to retain its AES license, the company must file an intervention in Case No. U-17137 by January 7, 2013 and appear at a hearing on January 29, 2013 before Administrative Law Judge Mark E. Cummins ALJ) that will take place at 9:00 a.m. at Constitution Hall, 525 W. Allegan, Lansing, Michigan. The Staff shall also attend the hearing," the PSC ordered.
