Maryland Denies Electric Supplier License Application

The Maryland PSC has denied, without prejudice, the electric supplier license application of Superb Power and Light.
The PSC found that in its original application, Superb Power and Light did not disclose that its affiliates include Horizon Power and Light, REP Energy, LLC and Summer Energy, LLC. Additionally, the PSC said that the original application did not disclose actions taken against affiliates Horizon Power and Light, LLC and TexRep5, LLC d/b/a All Star Energy.
Superb Power and Light later supplemented its application disclosing the affiliates and actions in response to a Staff review.
"Superb claims that it did not understand the Commission’s disclosure regulations pertaining to affiliates, but now acknowledges that, even with that being the case, they should have erred on the side of disclosing. The Commission appreciates Superb’s recognition, but also points out that the Company had reason to know that it was required to disclose the information, as the action taken against its affiliate in Texas stemmed from a similar failure to disclose," the PSC said.
"Superb was required to fully disclose information pertaining to its affiliates and actions taken against them. Its failure to do so in its Application -- particularly with regard to the revocation actions -- indicates that Superb was not forthcoming with the Commission," the PSC said.
The PSC will allow Superb to re-apply for licensure after six months. Any such new application must include complete, cumulative data from all jurisdictions where Superb and its affiliates are licensed up to the time of the new application, the PSC said.
