Demand Response Provider to Pay $80,000 Under Maryland Settlement

Comverge, Inc., the Staff of the Public Service Commission of Maryland, the Office of People's Counsel, and the Potomac Electric Power Company have entered into a settlement to resolve a dispute concerning Comverge's performance under the "Gap RFP" contract awarded to the company by the Maryland PSC.
The dispute centered on the use of demand resources outside of the Pepco-Maryland distribution service area, but within the Pepco load zone as defined by PJM, to meet the required quantities of demand resources under the contract. The Gap RFP had sought demand resources to assure reliability in the face of what the PSC considered projected shortages in PJM capacity.
Under the settlement, Comverge will pay Pepco $80,000 which will constitute full and final payment due under the Gap contract and the settlement agreement.
