Regulator Issues Notice to Revoke Retail Supplier's License

The Ontario Energy Board has issued a notice of its intent to make an order revoking the Energhx Green Energy Corporation's electricity retailer and gas marketer licences.

The Board said that it intends to take the action because, "Energhx has failed to comply with a provision of an Order of the Board and a condition of its electricity retailer and gas marketer licence, specifically the requirement to pay an administrative penalty and the condition to file certain information with the Board."

The Board had previously ordered, among other things, that Energhx pay an administrative penalty of $10,000 by no later than December 31, 2012.

Energhx has requested and received several extensions for the payment deadline, but according to the Board, failed to pay the administrative penalty by the latest deadline of August 29, 2013.

According to the Board, on August 30, 2013, Energhx wrote to the Board and requested a further extension of time to pay the penalty. On that same date, Compliance Counsel responded indicating that Compliance Staff opposed the request for extension.

Energhx may request that the Board hold a hearing on the matter
