Pennsylvania Stays Consideration of Petition for Declaratory Order Regarding FirstEnergy Solution Pass-Through Clauses

The Pennsylvania PUC has stayed consideration of a petition for a declaratory order concerning permissibility of the pass-through clauses used by FirstEnergy Solutions to pass higher ancillary service costs on to certain fixed rate customers.
As first reported by EnergyChoiceMatters.com, on April 8, 2014, the Utility Workers Union of America filed a petition for declaratory order from the PUC, asking the PUC to find that FirstEnergy Solutions' fixed price contract language does not permit FES to increase its bills to residential customers because of higher ancillary service costs.
"Please be advised that this Petition for Declaratory Order proceeding, including the filing of any answers and other filings, is hereby stayed effective April 24, 2014 pending further action of the Commission," the PUC said yesterday in a secretarial letter.
Separately, the PUC has assigned a docket for an investigation of the FES pass-through clauses, but postponed consideration of an order in the proceeding until its May 22 meeting.
