ESCOs: 'All Marketing Vendors', Including Brokers, Should Be Subject to New York PSC Licensing/Oversight

All marketing vendors in New York, including brokers, should be, "subject to the PSC licensing and oversight process," the Retail Energy Supply Association said in comments to the New York PSC.

"It is recommended that all marketing vendors including brokers be subject to the PSC licensing and oversight process. This will help ensure that all participants in the marketing process are properly incentivized to operate in a credible manner. Too often all responsibility falls on the ESCO to independent entities [sic], are complying with the UBP and other applicable regulations [sic], and the vendor never suffers any harm associated with its improper behavior. To correct this situation, the reasonable approach is to make sure the vendor has some 'skin' in the game and there is a cost to acting in an untoward manner. Applying PSC oversight would be a credible incentive," RESA said.
