PURA Said to Have Made in Error in Issuing NOV to Spark Energy

Spark Energy said that the Connecticut PURA has confirmed to Spark that a Notice of Violation issued to Spark Energy last week was made in error.

The NOV had alleged that Spark had not filed a gross receipts report, but Spark said that it filed such report, and Spark said that PURA has confirmed to Spark that the NOV was issued in error. The NOV had sought a $5,000 penalty.

As noted in our original story on a series of NOVs issued by PURA last week, PURA has a history of issuing notices of non-compliance, only to rescind the notices when challenged by evidence of compliance by the targeted retail supplier.

In a separate update, Xoom Energy, to which PURA late last week also issued an NOV regarding the gross receipts report, informed PURA that it erroneously filed the report with the Connecticut Siting Council. When alerted to this error by PURA in August, Xoom immediately sent the report to PURA. Noting that it has never had a prior NOV in Connecticut, Xoom asked PURA to retract the NOV.

After the initial batch of NOVs, PURA also issued a notice to North American Power & Gas alleging that NA Power has not submitted its gross receipts report, and seeking a $5,000 fine.
