Stream to Pay $20,000 to Resolve Investigation of Texas Complaints

Stream Spe, Ltd. would pay $20,000 under a settlement with PUCT Staff to resolve allegations that Stream, "in certain limited instances," was not in compliance with several provisions of the Substantive Rules.

Staff's investigation was a result of certain customer complaints.

"The investigation revealed that in certain limited instances Stream was not in compliance with PURA §§ 17.004 and 39.101," Staff said, as well as the following substantive rules:

- P.U.C. SUBST. R. 25.483(a), relating to disconnection and reconnection policy. Staff alleged that Stream issued a disconnection order after the customer complied with the terms of their deferred payment plan resulting in a wrongful disconnection.

-P.U.C. SUBST. R. 25.475(e)(2), relating to contract expiration and renewal offers and affirmative consent. For one of the customer complaints investigated, Staff alleged that Stream was unable to verify a customer's consent of re-enrollment.

- P.U.C. SUBST. R. 25.481(b)(2), relating to requirements for billing charges. Staff alleged that Stream failed to obtain proper consent from the customer regarding the additional product or service provided.

Prior to Staff's investigation into the aforementioned complaints, Stream provided reimbursements and took corrective action with the affected customers as appropriate which Staff took into consideration as mitigating factors.
