Texas Staff Seek Revocation of REP Certificate of DTE Energy Trading, Inc.

Staff of the Public Utility Commission of Texas have petitioned for the revocation of the retail electric provider certificate of DTE Energy Trading, Inc. for failure to serve customers within two years of its certificate being granted.

P.U.C. SUBST. R 25.107(j)(13) provides that a REP certificate may be revoked for, "[n]ot providing retail electric service to customers within 24 months of the certificate being granted by the commission"

Not providing retail electric service to customers within 24 months of the certificate being granted by the commission is defined as a "significant violation" under the rule.

The Commission approved DTE Energy Trading's application for a REP certificate under docket No. 35216 through a final order issued on February 18, 2008

"When DTE failed to file its Quarterly Performance Measure report for the 1st Quarter, 2012, Staff contacted DTE for the required information. However, communications provided by DTE indicate that it has not served any retail customers since it received its certification in February, 2008," Staff said.

"DTE's failure to provide retail electric service to customers within 24 months of certification is grounds for revocation," Staff said.

DTE Energy Trading has the opportunity to request a hearing on the merits of Staff's petition.
