The New York State Public Service Commission said that the PSC has, "revoked the eligibility of API Energy, LLC to operate as an energy services company (ESCO) in New York State and Prime Time and PTM Marketing & Consulting to serve as energy brokers or energy consultants."

Note that the PSC's news release refers to an entity as "Prime Time"; based on the PSC's referenced case number, the entity subject to revocation is understood to be Prime Time Marketing, LLC

Final orders were not immediately available

As previously reported, show cause orders had been issued against each entity. It does not appear any of the entities filed a substantive response to the show cause orders

With regards to API Energy, LLC, DPS Staff alleged that API Energy failed to file, for 2026, an annual compliance filing required from ESCOs, and was non-responsive to Staff notices concerning such

Regarding Prime Time Marketing, LLC and PTM Marketing & Consulting, see full background on the alleged violations which prompted the show cause orders in ECM's prior story here

In brief, DPS Staff had alleged slamming by PTM Marketing & Consulting Inc., and alleged that PTM Marketing & Consulting Inc. was using non-employee independent sales contractors who were not registered with the PSC, as is required by the PSC's broker regulation order

In brief, as stated in the show cause order, an ESCO told the PSC that a door-to-door marketer, Prime Time Marketing LLC, allegedly submitted customer enrollments to Con Edison that consisted of certain imaginary or "made-up" customer information in order to fraudulently collect commissions from the ESCO.

The PSC generally said that the revocations resulted from violations described as follows: "These violations include failure to submit annual required compliance filings, using unregistered subcontractors for customer enrollments, and conducting improper customer enrollments or attempted enrollments unauthorized by the customer."

Commission Chair Rory M. Christian said, “The Public Service Commission is laser focused on protecting the public, enforcing the rules, and demanding accountability by putting people, not private interests, first. To conduct business in New York, private energy companies must comply with all applicable orders from this Commission. If companies fail to comply, we will take swift action.”

Case Numbers 26-M-0426 (API Energy, LLC), 26-M-0519 (PTM Marketing & Consulting Inc.), 26-E-0522 (Prime Time)
